8cast does not provide legal, tax, investment, audit, assurance, or certified public accounting services. You should consult your attorney, CPA, tax advisor, investment advisor, or other licensed professional before relying on any information for legal, tax, accounting, regulatory, or investment decisions.

 

4. Client Responsibilities

You are responsible for:

  • Providing accurate, complete, and current information

  • Reviewing all reports, dashboards, models, recommendations, and outputs

  • Making final business decisions

  • Confirming the accuracy of source data

  • Maintaining access to your own systems, platforms, accounts, and records

  • Ensuring you have the right to share any data or materials with 8cast

  • Complying with applicable laws, contracts, and platform terms

 

8cast is not responsible for errors caused by inaccurate, incomplete, outdated, or misleading information provided by you or third parties.

 

5. Use of Website

You agree not to:

  • Use the website for unlawful purposes

  • Attempt to gain unauthorized access to systems, data, or accounts

  • Interfere with website security or functionality

  • Copy, scrape, reverse engineer, or misuse website content or tools

  • Upload malicious code, viruses, or harmful files

7. Artificial Intelligence and Automated Outputs

8cast may use artificial intelligence, automation, machine learning, data analytics, or software-assisted workflows to support transaction categorization, reporting, dashboards, recommendations, content generation, and analysis.

AI-assisted outputs may contain errors, omissions, inaccuracies, or incomplete conclusions. You are responsible for reviewing and validating all outputs before relying on them.

Unless expressly agreed in writing, 8cast does not guarantee that AI-generated or software-generated outputs will be error-free, complete, compliant, or suitable for any specific business, legal, tax, accounting, financing, or investment purpose.

 

8. Reports, Dashboards, and Deliverables

Deliverables may include financial models, reports, dashboards, documents, spreadsheets, presentations, recommendations, templates, or other work products.

 

Unless otherwise agreed in writing:

  • Final deliverables prepared specifically for you may be used by you for internal business purposes.

  • 8cast retains ownership of its pre-existing tools, methods, templates, frameworks, code, processes, know-how, and intellectual property.

  • You may not resell, sublicense, publish, or distribute 8cast deliverables to third parties without written permission.

  • 8cast may reuse general knowledge, methods, workflows, templates, and non-confidential learnings developed through its work.

 

9. Payments and Fees

Fees, payment terms, deposits, subscriptions, retainers, hourly rates, fixed project fees, and billing schedules will be stated in a proposal, invoice, checkout page, written agreement, or other ordering document.

Unless otherwise stated:

  • Payments are due according to the applicable invoice or agreement.

  • Late payments may result in paused work, delayed delivery, or termination of services.

  • Fees are non-refundable once work has begun, except as required by law or agreed in writing.

  • You are responsible for applicable taxes, payment processing fees, and other charges unless otherwise stated.

 

10. Third-Party Platforms

Our services may involve third-party platforms such as accounting software, CRM systems, email platforms, analytics tools, dashboard tools, payment processors, advertising platforms, cloud hosting providers, and AI tools.

Your use of third-party platforms is subject to their own terms and privacy policies. 8cast is not responsible for third-party platform errors, outages, data loss, security incidents, pricing changes, or policy changes.

 

11. QuickBooks and Connected Accounts

If you connect QuickBooks or another third-party account to 8cast or authorize us to access your data, you are responsible for ensuring that such access is authorized and appropriate.

8cast may use connected data to categorize transactions, create reports, generate insights, support dashboards, and provide recommendations. You remain responsible for reviewing outputs and maintaining your official books and records.

 

12. Confidentiality

Each party may receive confidential or sensitive information from the other. Unless otherwise agreed, both parties agree to use reasonable care to protect confidential information and not disclose it except as needed to provide services, comply with law, work with service providers, or as otherwise authorized.

Confidential information does not include information that is publicly available, independently developed, already known without restriction, or lawfully received from another source.

 

13. Intellectual Property

All website content, branding, logos, text, graphics, designs, templates, processes, software, workflows, methodologies, and other materials owned or developed by 8cast are protected by intellectual property laws.

You may not copy, modify, reproduce, distribute, sell, or exploit 8cast intellectual property without written permission.

 

14. Testimonials and Case Studies

We may request permission to use your name, logo, testimonial, project description, or results in marketing materials. We will not publicly disclose confidential client information without consent.

If you provide a testimonial or review, you grant 8cast permission to use it in marketing, sales, website, and promotional materials.

15. Disclaimers

The website and services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, 8cast disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, or error-free operation.

We do not guarantee specific business outcomes, revenue increases, fundraising results, financing approvals, cost savings, tax results, accounting outcomes, or investment performance.

 

16. Limitation of Liability

To the fullest extent permitted by law, 8cast will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, or lost opportunities.

To the fullest extent permitted by law, 8cast’s total liability for any claim related to the website, services, or these Terms will not exceed the amount you paid to 8cast for the specific service giving rise to the claim during the three months before the claim arose.

 

17. Indemnification

You agree to indemnify and hold harmless 8cast Corporation, its officers, directors, employees, contractors, agents, and affiliates from claims, damages, liabilities, costs, and expenses arising from:

  • Your use of the website or services

  • Your violation of these Terms

  • Your violation of law or third-party rights

  • Data, materials, or instructions you provide

  • Business decisions made based on reports, dashboards, models, or recommendations

 

18. Termination

  • Payment is overdue

  • Continued service creates legal, security, operational, or reputational risk

  • We are required to do so by law

  • A separate agreement permits termination

 

Termination does not affect payment obligations, confidentiality obligations, intellectual property rights, disclaimers, indemnities, or liability limits.

 

19. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
